====================================================== CORAM: HONOURABLE MR. JUSTICE BIRENDRA KUMAR ORAL ORDER 11-07-2017 Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State.

The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 406, 420, 465, 467, 468, 201 and 120B of the Indian Penal Code. Allegation against the petitioners is that they were office bearers of AApna Pariwar Agro Farming Developments India Limited, a non-financing company and they induced the informant to deposit money in the company to get better result. Submission of the learned counsel for the petitioners is that the petitioners were also cheated by the same company as they had also deposited money. The informant was also an agent of the company like the petitioners. Since the company fled away

Patna High Court Cr.Misc. No.20779 of 2017 (4) dt.11-07-2017 2/2 the office bearers of the company as well as the petitioners have been arrayed as accused.

Considering the fact that the petitioners have also deposited money in the said company, hence, the petitioners were satisfied that the company is working well and there is no material to disclose intention of the petitioners from very inception that they are going to cheat others, let the petitioners, above named, in the event of their arrest or surrender before the Court below within a period of thirty days from the date of receipt of the order, be released on bail on furnishing bail bonds of Rs.20,000/- (Twenty Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Araria/successor Court in connection with Araria Police Station Case No. 65 of 2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure as well as condition that the petitioners shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioners.
