2. Petitioners apprehend arrest in a case registered for the offence punishable under sections 341, 323, 324, 325, 307, 379, 504, 506/34 of the Indian Penal Code.

3. As per the prosecution case, on the alleged date and time of the occurrence, when the informant was working in his field, all the FIR named accused persons including these petitioners came there and on protest, petitioner no.1 tried to dismantle the cement pillar which was used to mark boundary of his field and petitioner no.2 hit the informant on his head with garasa as a result of which his sustained head injury.

4. It is submitted on behalf of the petitioners that there is land dispute between the parties due to which marpit

Patna High Court CR. MISC. No.69827 of 2024(3) dt.21-03-2025 2/2 took place between the parties in which both sides sustained injuries. There is case and counter case. Doctor has found simple injury. There is no allegation of assault against petitioner no.1.

5. Learned counsel for the State as well as the informant oppose the prayer for bail.

6. Considering the aforesaid facts of the case, prayer for bail of all the petitioners is allowed. In the event of arrest/surrender within eight weeks from today, let these petitioners, mentioned above, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Judicial Magistrate 1st class, Nawada in Sirdala Police Station Case No. 156 of 2024, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
