Mr.Sri Anil Kumar ====================================================== CORAM: HONOURABLE MR. JUSTICE SANJAY PRIYA ORAL ORDER 22-02-2019 Heard the learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner seeks bail in Jagdishpur (Goradih) P.S. Case No. 352/2017, corresponding to S.Tr. No. 261/2018, instituted for offences under Section(s) 365, 366 of the Indian Penal Code. Later on Sections 302, 201 and 120(B) of the Indian Penal Code has been added.

Learned counsel for the petitioner has submitted that name of this petitioner has come during investigation merely on suspicion because the SIM, as alleged in the written report, which was used by this petitioner and other accused persons, belongs to the mother of this petitioner.

It is alleged in the written report that informant brought his cousin sister on motorcycle. The cousin sister of

Patna High Court Cr.Misc. No.74759 of 2018(4) dt.22-02-2019 2/2 informant received telephonic call on her mobile. Mobile number of aforesaid call is mentioned in the written report. Thereafter one unknown tall and healthy person came and took his cousin sister on motorcycle towards Katihar. The informant raised suspicion that owner of mobile number i.e. 8298873300 has kidnapped his cousin sister.

During investigation four pieces of bone of dead body was recovered, which was sent to Forensic Science Laboratory. The report of laboratory is still waiting.

Petitioner is in custody since 28.11.2017.

Considering the aforesaid facts and circumstances, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned 1st Addl. Sessions Judge, Bhagalpur in connection with Jagdishpur (Goradih) P.S. Case No. 352/2017, corresponding to S.Tr. No. 261/2018, subject to the conditions that both the bailors shall be the close relative of the petitioner.
