JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 07-07-2023 Heard learned counsel for the petitioner and the State. Petitioner apprehends his arrest in a case registered for the offence punishable under Section 7 of the E. C. Act and u/s 7 of Fertilizer Control Order.

Allegation against this petitioner is that he was involved in black marketing of fertilizer (Urea) and also smuggling of the same to Nepal.

Learned counsel appearing for the petitioner submits that petitioner is innocent and has falsely been implicated in the case. It is further submitted that driver of the vehicle and owner of seized goods have already been granted pre arest bail by coordinate Benches of this court vide order passed in Cr. Misc. Nos. 66634/ 2022 and 71233/ 2022 respectively. Petitioner has

No.66631 of 2022(6) dt.07-07-2023 2/2 got no concern with the seized fertilizer and he has been made accused in this case only because he is owner of the vehicle in question. Petitioner has got clean antecedent. Learned counsel appearing for the State opposes the prayer for anticipatory bail.

Considering the facts of the case, nature of accusation and clean antecedent of the petitioner, let the petitioner, above named, in the event of his arrest/ surrender within a period of six weeks from today shall be enlarged on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sub divisional Judicial Magistrate, Sadar, Sitamarhi in connection with Bela PS case No. 214/ 2022, subject to conditions laid down u/s 438(2) of the Cr. P. C.
