JUSTICE MOHIT KUMAR SHAH ORAL ORDER 23-04-2024 The present writ petition has been filed seeking the following reliefs:- "1. i) For issuance of appropriate writ(s) thereby quashing and setting aside the letter No. 570 dated 22.3.2022 issued under the seal and signature of Respondent no. 6 whereby and whereunder the said respondent has informed the Petitioner that her services as Para Legal Volunteer (PLV) in senior citizen Tribunal (Legal Services Clinic), Siwan has not been extended as she was not found to have qualified in the

Patna High Court CWJC No.18464 of 2022(2) dt.23-04-2024 2/3 interview held in the year 2021 by the Interview Board at District Legal Services Authority, Siwan.

(ii) For consequently issuance of appropriate writ(s) thereby commanding and directing the respondents to consider the Petitioner's eligibility for extension of her engagements as PLV in senior citizen Tribunal (Legal Services Clinic) at Siwan for proper implementation of Maintenance and Welfare of Parents and Senior Citizens Act, 2007 (NALSA Legal Services to Senior Citizens Scheme, 2016) as she is well qualified having social worker along with M.A in Political Science and possessing substantial experience to work as PLV since the year 2018 to March 2021 at Siwan.

iii.) For further direction upon the respondents to pay the Petitioner arrears of her remuneration for the Period March 2018 to March 2021 which is due in part while working as PLV at Siwan."

At the outset, the learned counsel for the petitioner has limited the prayer made in the present writ petition to issuance of a direction to the Secretary, District Legal Services Authority,

Patna High Court CWJC No.18464 of 2022(2) dt.23-04-2024 3/3 Siwan to make payment of the admitted outstanding amount of honorarium for the period she has worked.

Having regard to the limited prayer made by the petitioner, I deem it fit and proper to grant liberty to the petitioner to approach the respondent no. 6 i.e. the Secretary, District Legal Services Authority, Siwan, by filing appropriate representation within a period of two weeks from today, setting out therein her claim for payment of outstanding amount of honorarium, which shall be disposed off by the respondent no. 6, by passing a reasoned and a speaking order, in accordance with law, within a period of six weeks, thereafter. 4.

The writ petition stands disposed off on the aforesaid terms.
