2. The petitioner seeks bail in connection with Bhagwanpur P.S. Case No. 156 of 2024 dated 08.06.2024 registered for the offences punishable under Sections 120B, 302 read with Section 34 of the I.P.C.

3. As per the prosecution case, on 07.06.2024, the informant's sons, namely, Pankaj Kumar and Aman Kumar had gone to Belaon Bazzar for purchasing vegetables and after that Pankaj Kumar handed over the vegetables and mobile to his

2/4 younger brother, Aman Kumar, and also said to return. Later on, Pankaj Kumar did not return to his village then the informant and other persons started searching for him and during search, the informant came to know that a dead body is lying at 'Maa Kali Temple'. When the informant went 'Maa Kali Temple' alongwith his family members, they found the dead body of the deceased, Pankaj Kumar. It is further alleged that the informant suspected that the petitioner and the other co-accused persons killed his son and threw his dead body near the 'Maa Kali Temple'.

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in the present case. It is further submitted that the petitioner had no enmity with the informant or the deceased and there is no evidence on record to connect the guilt of the petitioner in the present case. The petitioner has been made accused in the present case only on the basis of suspicion raised by the informant. There is no specific allegation against the petitioner. There is general and omnibus allegation against the petitioner. It is further submitted that there was love affair between the daughter of the co-accused Chhangur Ram and the son of the informant Pankaj Kumar and eight months ago, Pankaj Kumar

3/4 (deceased) had kidnapped the daughter of Chhangur Ram for which the co-accused Chhangur Ram had lodged criminal case against Pankaj Kumar and others in which he was remained in jail custody and thereafter he was released on bail and accused persons had threatened to kill Pankaj Kumar after his release on bail as stated in paragraph no. 9 of the bail petition. No incriminating article has been recovered from the possession of the petitioner. He has no concern with the alleged offence. It is further submitted that the other co-accused persons Harendra Ram and Belash Ram @ Ram Belash Ram have already been granted bail by a Bench of this Court vide Cr. Misc. No. 69630 of 2024 under order dated 18.02.2025. The petitioner has clean antecedent as as stated in paragraph no. 3 of the bail application. The petitioner is in custody in this case since 09.06.2024.

5. Learned A.P.P. for the State has vehemently opposed the prayer for bail petition of the petitioner.

Considering the aforesaid facts and circumstances of the case as well the period of custody, let the above named petitioner, be enlarged on bail on furnishing bail bond of Rs. 20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M., Bhabhua, Kaimur in connection with Bhagwanpur P.S. Case No.

4/4 156 of 2024.

7. The application stands allowed.
