In view of such, the entire proceedings including the order of cognizance dated 4.10.2012 passed by the Judicial Magistrate, Motihari in Trial No.305 of 2012 arising out of Complaint case No.C-1462 of 2010 as also Complaint case No.1705 of 2010 (Trial No.3921 of 2012) filed by the Petitioner against the Opposite Party No.2 pending in the court of Judicial Magistrate, Motihari are hereby set aside.

Patna High Court Cr.Misc. No.49922 of 2012 dt.18-08-2015 2/2 Application stands allowed with the aforesaid observations.
