JUSTICE VINOD KUMAR SINHA ORAL ORDER 09-01-2019 Earlier prayer for bail of the petitioner was rejected by this Court vide order dated 12.9.2017 passed in Cr.Misc.No.42382 of 2018 with observation to expedite the trial and conclude it within a period of nine months and if not concluded petitioner was given liberty to renew his prayer for bail and allegation against the petitioner is of recovery of 23 kg. of ganja from his tempo.

Submission of learned counsel for the petitioner is that thereafter two accused persons have been granted bail by this Court vide order dated 10.10.2018 in Cr.Misc.No. 62497 of 2018 and vide order dated 18.9.2018 in Cr.Misc.No. 40291 of 2018 by co-ordinate Bench of this Court and petitioner has remained in custody since 10.7.2017.

Heard learned APP also.

No.73168 of 2018(3) dt.09-01-2019 2/2 Having heard both sides and in the facts and circumstances,as stated above, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Additional District and Sessions Judge-I, Bhagalpur, in connection with N.D.P.S. G.R. No. 3126 of 2017, arising out of Gopalpur (Rangra) P.S. case No. 154 of 2017, subject to the conditions that one of the bailors shall a local person, having sufficient immoveable properties within the jurisdiction of the court concerned and petitioner has to co-operate in disposal of trial and appear in court as and when required, otherwise prosecution is at liberty to move for cancellation of his bail bond.
