====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 16-09-2025 Heard learned counsels for the petitioners and learned A.P.P. for the State.

2. Petitioners apprehend arrest in a case registered for the offences punishable under Sections 363, 366-A, 504, 506/34 of Indian Penal Code.

3. It is alleged co-accused Nand Kishor Mandal kidnapped minor daughter of the informant for the purpose of marriage. Petitioner no. 1 is father and petitioner no. 2 is mother of co-accused Nand Kishor Mandal.

4. Learned counsel appearing for the petitioners submits that victim in her statement, recorded under Section 164 of Cr.P.C., has denied the factum of kidnapping and has

Patna High Court CR. MISC. No.64480 of 2025(2) dt.16-09-2025 2/2 categorically stated that she was in love with co-accused Nand Kishor Mandal and they have solemnized marriage and are living together as husband and wife. Petitioners claim clean antecedent.

5. Learned A.P.P. for the State vehemently opposed the bail application.

Considering statement of the victim recorded under Section 164 of Cr.P.C., this anticipatory bail is allowed and it is ordered that the above named petitioners in the event of their arrest/surrender before the court below within a period of eight weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of District & Additional Sessions Judge 7th cum Special Judge (POCSO), Madhubani in connection with Ghoghardiha P. S. Case No. 76 of 2023, subject to condition as laid down under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.
