JUSTICE VINOD KUMAR SINHA ORAL ORDER 03-05-2017 This is an application for grant of anticipatory bail for offences punishable under Sections 341, 323, 307, 506 and 34 of the Indian Penal Code.
Allegation against the petitioner is that on a very trifle matter an altercation took place between the parties and petitioner along with other accused persons has abused and assaulted informant side.
Heard learned counsel for the petitioner.
It has been submitted on behalf of the petitioner that he has falsely been implicated in this case. There is land dispute between the parties. No case under Section 307 IPC is made out. At best it is a case under Section 336 IPC.
Heard learned A.P.P. also.
Patna High Court Cr.Misc. No.18400 of 2017 (2) dt.03-05-2017 2/2 Considering the allegation of throwing acid against the petitioner, causing injury, I am not inclined to grant anticipatory bail to the petitioner.
However, petitioner is directed to surrender in the court below, i.e., learned Judicial Magistrate, Ist Class, cum Addl. Munsif, Patna City, in connection with Khusrupur P. S. Case no. 202 of 2016 and make prayer for regular bail which will be considered on its own merit without being prejudiced by the order of this Court.
