The petitioner seeks bail in connection with Chanpatia P. S. Case No 409 of 2018 instituted for the offence under Section 30(a) of the Bihar Prohibition and Excise Act. Allegation is of recovery of 97.920 M.L. of liquor from Tata Indigo Car. It appears that petitioner is not named in the F.I.R. his name transpired on confession of co-accused. Apart from that he is accused in two other cases. Submission of learned counsel for the petitioner is that so far this case is concerned, save and except confession of co-accused, there is absolutely nothing against the petitioner and the car from which recovery was made, does not belong to the
Patna High Court CR. MISC. No.74278 of 2019(3) dt.03-02-2020 2/2 petitioner and further he has been in judicial custody since 09.07.2019.
Considering the submissions as above, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge, Excise, West Champaran at Bettiah, in connection with Chanpatia P. S. Case No 409 of 2018 .
