JUSTICE VINOD KUMAR SINHA ORAL ORDER 21-02-2019 Earlier, the prayer for bail of the petitioner was dismissed vide order dated 11.10.2017 passed in Cr. Misc. No. 46778 of 2017 with direction to the trial court to conclude the trial within a period of one year. Petitioner is husband of the deceased and allegation against him is of causing death of the deceased in connection with demand of dowry.

Submission of learned counsel for the petitioner is that he has been in judicial custody since 21.06.2017 and uptil now no substantial progress has been made in trial. Heard learned A.P.P. also.

Having heard both sides and perused the report of the learned trial court, from which, it appears that out of ten witnesses, four witnesses have been examined and he has taken

Patna High Court Cr.Misc. No.74705 of 2018(3) dt.21-02-2019 2/2 steps for examination of other witnesses.

In such view of the matter, I am not inclined to enlarge the petitioner on bail. However, since the petitioner has been in custody since long, the trial court is directed to expedite the trial and conclude the same as early as possible. At the same time, Superintendent of Police, Motihari, East Champaran, is directed to ensure the production of witnesses in the trial court on the date fixed so that the trial be concluded expeditiously.
