The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 341, 323, 325, 307, 379/34 of the Indian Penal Code.

The prosecution case, in brief, is that the petitioner and one Anil came and on the pretext of hiring E-rickshaw they took the informant at their village where they assaulted the informant with knife and snatched Rs.500/- and gold chain from the informant.

It is submitted by learned counsel for the petitioner that the petitioner has falsely been implicated in the present case and for the occurrence of 05.06.2022 the FIR was lodged on 15.06.2022 after delay of 10 days and there is no explanation for

Patna High Court CR. MISC. No.67500 of 2022(3) dt.06-02-2023 2/2 such inordinate delay. It is further submitted that the injury has been found to be simple in nature. A statement has been made in paragraph 3 of the petition that the petitioner is not having any criminal antecedent.

Learned APP opposed the prayer for anticipatory bail.

Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned court below where the case is pending/successor court in connection with Sultanganj P.S. Case No. 184 of 2022, subject to the conditions laid down under Section 438(2) of the Cr.P.C. (Anjani Kumar Sharan, J) DKS/- U
