2. The petitioner apprehends his arrest in connection with Ahiyapur P.S. Case No. 970 of 2025, registered under Section 30(a) of the Bihar Prohibition and Excise Amendment Act, 2016.

As per the first information report, on a secret information that trade in illicit liquor is made from a hut situated in a field in the village, a raid was conducted, on seeing the police party, two persons present there tried to flee away, however, one was apprehended. On search, 4.5 liters of beer and 4 liter country made liquor along with one motorcycle bearing registration No. BR-06DW-8553 were recovered and seized.

4. Learned counsel for the petitioner submits that the seized liquor was recovered from a hut, which is in joint ownership of the petitioner and further the petitioner has nine

Patna High Court CR. MISC. No.66257 of 2025(2) dt.24-09-2025 2/2 criminal antecedents, in which he is on bail, but none of the cases relate to the excise matter. The name of the petitioner has surfaced on the disclosure made by one co-accused, namely, Dipak Kumar, who was arrested from the place of seizure. The seized motorcycle also does not belong to the petitioner.

Considering the submissions made by the learned counsel for the petitioner, the petitioner, above named, is directed to be released on anticipatory bail in the event of arrest or surrender before the court below within a period of four weeks from today on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Exclusive Special Judge, Excise Court-I, Muzaffarpur, in connection with Ahiyapur P.S. Case No. 970 of 2025 subject to the condition as laid down under Section 482 (2) of the B.N.S.S., 2023.
