JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 09-01-2019 Heard learned counsel for the petitioner and State. The petitioner is in custody in connection with Sugauli Rail P.S. Case No. 38 of 2018 for the offence under Sections 386/420/323/34 of the Indian penal Code. Learned counsel for the petitioner submits that the petitioner has no criminal antecedent. He also submits that allegation against this petitioner is that he was one of the companion of the girl who seated in the Bolero vehicle and the informant was taken to lonely place by Bolero and his belongings were snatched on the threat of dire consequences. Considering the fact that petitioner has no criminal antecedent and he has remained in custody since 31.7.2018 and similarly circumstanced other co-accused has been granted bail by the co-ordinate Bench of this Court vide order dated

Patna High Court Cr.Misc. No.72174 of 2018(3) dt.09-01-2019 2/2 20.12.2018 in Cr. Misc. No. 69901 of 2018, let the petitioner named above, is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, West Champaran in connection with Sugauli Rail P.S. Case No. 38 of 2018.
