The petitioner is languishing in custody since 10.08.2018 in a case registered for the offences punishable under Sections 376, 341, 323, 504 and 506 of the Indian Penal Code.

The prosecution case is that the petitioner, being the father-in-law of the informant Jitni Devi, used to ravish the informant since her husband was a person of abrasion mind. It is submitted by learned counsel for the petitioner that the accusation has falsely been levelled against the petitioner and the investigation has already been concluded. It is further submitted that the medical report of the victim does not

Patna High Court Cr.Misc. No.75702 of 2018(3) dt.20-02-2019 2/2 suggest the accusation of rape. A statement has been made in paragraph no.3 of the petition that the petitioner is not having any criminal antecedent.

Learned APP for the State submits that there is specific accusation against the petitioner of committing rape upon the informant and even the neighbors of the informant have suggested that the petitioner used to ravish the informant. Considering the nature of accusation, this Court is not inclined to grant bail to the petitioner for the present. Accordingly, the prayer for bail of the petitioner in connection with Supaul Mahila P.S. Case No.99 of 2018, pending before the learned SDJM, Supaul is rejected. (Dinesh Kumar Singh, J) Ashwini/- U T
