JUSTICE VINOD KUMAR SINHA ORAL ORDER 24-09-2019 This is an application for grant of anticipatory bail in connection with Gopalganj P.S. Case No. 123 of 2019, disclosing offences under Sections 414, 34 of the Indian Penal Code and Section 30, 30(a) of the Bihar Prohibition and Excise Act, 2016.

As per F.I.R. one car was intercepted by the police and huge quantity of liquor was recovered from the said car. Petitioner and other accused persons are named by the villagers. Submission of learned counsel for the petitioner is that there is no source of identification. Petitioner is not owner of the car. Petitioner has no criminal antecedent. Heard APP also, who has opposed the prayer for anticipatory bail of the petitioner.

Having heard both sides, in view of the facts, as stated

Patna High Court CR. MISC. No.60268 of 2019(2) dt.24-09-2019 2/2 above, this application is disposed of with a direction to the petitioner to surrender before the learned court below and the learned Special Judge Excise Act shall verify the fact that as to what is the source of information and if, it is only a general information, not naming any witness, petitioner shall be released on bail to his own satisfaction, otherwise, petitioner has to pray for regular bail.
