2. This application has been filed for modification of order dated 14.12.2021 passed in Cr. Misc. No. 68284 of 2021.
3. Learned counsel appearing on behalf of the petitioner submits that the petitioner was granted anticipatory bail on 14.12.2021 passed in Cr. Misc. No. 68284 of 2021 with a direction to surrender before the Court below within twelve weeks from today, the petitioner be released on anticipatory bail upon furnishing bail bonds of Rs. 10000/- (Rupees Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge -II- cum- Excise Court, Vaishali at Hajipur in connection with Mahua P.S. Case No. 502 of 2021, but due to some unavoidable
Patna High Court CR. MISC. No.17319 of 2024(2) dt.20-04-2024 2/2 circumstances, the petitioner could not surrender before the Court below within the stipulated time. It is further submitted that the modification application of the order dated 14.12.2021 passed in Cr. Misc. No. 68284 of 2021 was filed on 24.03.2023, the said modification application was dismissed as withdrawn on the prayer of the learned counsel for the petitioner. Thereafter the second modification application has been filed.
4. In view of the matter, the petitioner was granted anticipatory bail on 14.12.2021 passed in Cr. Misc. No. 68284 of 2021 with a direction to surrender before the Court below within twelve weeks but the petitioner could not surrender before the court below within stipulated time without giving any cogent reason.
