The petitioner is in custody since 19.08.2019 in connection with Special Case No. 03 of 2018 arising out of Bihra P.S. Case No. 85 of 2018 for the offence registered under Sections 399 and 402 of the Indian Penal Code and Section 3, 4 and 5 of the Explosive Substance Act 1908 and Section 20 and 22 of the NDPS Act.

Learned counsel for the petitioner submits that the alleged recoveries were not from his conscious possession and that the recovery of ganja is also less than small quantity and, therefore, the petitioner may be extended the privilege of regular bail.

Considering the aforesaid facts and circumstances of

No.61221 of 2019(2) dt.05-11-2019 2/2 the case and that the petitioner has no criminal antecedent, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sessions Judge cum Special Judge, Saharsa in connection with Special Case No. 03 of 2018 arising out of Bihra P.S.
