2. The petitioner apprehends his arrest Daudnagar P.S. Case No. 510 of 2024, registered for offence under Sections 292, 75 of the Bhartiya Nagrik Suraksha Sanhita, 2023, Section 14 of the Sarai Act, 1867 and Sections 8, 12, 17 of the Protection of Children from Sexual Offences Act, 2012.

As per prosecution case, on 20.08.2024 at about 14.15 o'clock, on a secret information, the informant alongwith other police party conducted raid in a hotel where neither hotel owner nor manager was present and on search, they caught one boy aged about 22 years with a girl aged about 17 years and some used condoms were found in the room. It is further alleged that similarly, they caught other boys and girls on search of other rooms. On verification of reception register, it was found

Patna High Court CR. MISC. No.70671 of 2024(3) dt.21-01-2025 2/2 that they were staying in that hotel unauthorizedly without any entry in register. The apprehended boys and girls also told that hotel manager gave them rooms after taking Rs. 1000/- each without making any entry in register.

4. Learned counsel for the petitioner submits that petitioner has been falsely implicated in this case merely because he happens to be owner of the said hotel.

5. However, learned A.P.P. for the State vehemently opposes the prayer for anticipatory bail and submits that apprehended boys were caught with minor girls in the hotel, which is an offence and petitioner, who is hotel owner, has got one criminal antecedent of similar nature.

6. Considering the nature of accusation and criminal antecedent of similar nature, the prayer for anticipatory bail of petitioner is rejected.
