====================================================== CORAM: HONOURABLE MR. JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 20-02-2019 Heard learned counsel for the parties.

Considering the fact that the present matrimonial dispute is between husband and wife for divorce. The present case is pending in the Court of Principal Judge, Family Court, Nalanda and the petitioner has prayed for transfer of the case to the Court of Principal Judge, Family Court, Patna. Learned counsel appearing on behalf of opposite party submits that the relationship of the petitioner and opposite party i.e. wife and husband has reached the stage of no return and there is only possibility of divorce and no question of restoration of conjugal rights. He want that the matrimonial dispute be finally decided at the earliest so that party may decide their future course of action.

Considering the fact that the matrimonial (divorce)

Patna High Court MJC No.1112 of 2017(5) dt.20-02-2019 2/2 case is pending since 2016, with the consent of the parties the matrimonial (Divorce) Case No. 303 of 2015 pending in the Court of learned Principal Judge, Family Court, Nalanda is transferred to Principal Judge, Family Court, Patna. The Principal Judge, Family Court, Nalanda is directed to transferring the record of the case to transferee Court i.e. the Principal Judge, Family Court, Patna within a fortnight of production of the copy of this order and the transferee Court i.e. Family Court, Patna is directed to dispose of the matrimonial (Divorce) Case No. 303 of 2015 at the earliest preferably within a period of six months from the date of receipt/production of a copy of this order.

With the aforesaid, the present application stands disposed of.
