Petitioner seeks bail in a case registered for the offence punishable under sections 399 and 402 of the Indian Penal Code and sections 25(1-b)a and 26, 35 of the Arms Act. Learned counsel appearing for the petitioner submits that petitioner has been falsely implicated in this case. Nothing has been recovered from the conscious possession of this petitioner. Petitioner has been made accused only on the basis of confessional statement given by co-accused. Moreover, similarly situated co-accused person has been granted bail by co-ordinate Bench of this Hon'ble Court vide order dated 22.10.2019 in Cr. Misc. No. 63677 of 2019. Petitioner is in

Considering the facts and circumstances of the case and the submissions advanced on behalf of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Judicial Magistrate, 1st Class, Masaurhi, District- Patna in connection with Dhanarua P.S. Case No. 178 of 2019.
