The petitioner has prayed for the following reliefs: (i) for commanding the respondent authorities particularly the Respondent No.-5 (The Circle Officer, Tilauthu) to initiate the process of rent fixation and refer the same to the learned court of D.C.L.R. for disposal of the same within the stipulated period & time in pursuance to Annexure-2 of the

Patna High Court CWJC No.15110 of 2023(2) dt.23-04-2024 2/3 petition;

(ii) further commanding the respondent authorities to follow with the provisions of Bihar Tenancy (Amendment) Rules, 2018;

(iii) for grant of any other consequential or incidental relief/reliefs, for which the petitioner can be found entitled for.

3. It has been informed by the learned counsel for the petitioner that on 16.5.2023, the Rent Fixation Case was preferred before the Circle Officer Tilauthu, Rohtas but to his knowledge till date, the concerned Officer has not even given the case number.

4. Learned State Counsel submits that if such petition has been preferred, the Circle Officer, Tilauthu is duty bound to act and take the matter to its logical conclusion after hearing of the parties.

5. It is unfortunate if the submissions of the learned counsel for the petitioner is believed that despite passage of 11

Patna High Court CWJC No.15110 of 2023(2) dt.23-04-2024 3/3 months, even the case number has not been given by the Circle Officer, Tilauthu.

6. Accordingly, the writ petition stands disposed of with a direction to the respondent no.5, the Circle Officer, Tilauthu to take the Rent Fixation Case preferred by the petitioner on 16.5.2023 to its logical conclusion after hearing the parties and going through the records within a period of six months from the date the copy of the order is provided to him by the petitioner.
