2. The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 305(c), 317(2), 132, 109(1) and 3(5) of the B.N.S.

3. The case of the prosecution is that illegal sand was being transported by one unknown tractor from Falgu river and on that information, the informant along with other police personnel went there, as soon as they reached near Bihta Bhuitoli, one person started fleeing away by tractor. It is further alleged that when the police personnel tried to stop the said tractor, the driver of the said tractor tried to dash police personnel with intent to kill and also tried to damage the government vehicle. He was apprehended.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. Learned counsel for the petitioner has submitted that nothing has been recovered from the alleged tractor and the allegation regarding attempt to dash the police personnel is concocted one. Moreover, he is languishing in judicial custody since 27.06.2025.

5. Learned APP appearing for the State has vehemently opposed the prayer of regular bail and submitted that petitioner is having criminal antecedent of one case.

6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Hulasganj P.S. Case No. 208 of 2025 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Jehanabad.
