JUSTICE VINOD KUMAR SINHA ORAL ORDER 24-09-2019 Petitioner seeks bail in anticipation of his arrest in connection with Bettiah Town P.S. Case No. 505 of 2019 registered for the offence punishable under Section 30(a) of Bihar Prohibition and Excise Act.

Allegation is of recovery of 8 litres of liquor from the motorcycle and petitioner and another are named in the FIR. Submission of learned counsel for the petitioner is that he was pillion rider and there is no allegation that he was carrying the liquor and he has no criminal antecedent. Heard learned APP, who has opposed the prayer for anticipatory bail of the petitioner.

In view of above facts and circumstances, this application is disposed of with direction to the petitioner to

Patna High Court CR. MISC. No.60704 of 2019(2) dt.24-09-2019 2/2 surrender within a period of two weeks from the receipt of this order and on surrender the court below shall verify from the case diary as to what are the materials against the petitioner showing his involvement in this case apart from general statement and if there is nothing on the record to show as to who has identified him, the court below shall release the petitioner on bail, otherwise petitioner has to surrender and pray for regular bail.
