2. The petitioners apprehend their arrest in a case, registered for the offence under Sections 137(2), 96, 3(5) of the B.N.S., 2023.
3. As per F.I.R., on 14.04.2025, the daughter of the informant had gone to chowk Bazar to purchase some articles, but she did not return. On inquiry, the informant came to know that his daughter used to talk with co-accused Manish Paswan on mobile. The informant suspects that co-accused Manish Paswan and his family members have kidnapped his daughter for the purpose of marriage or selling her.
4. Learned counsel for the petitioners submits that specific accusation of kidnapping daughter of informant is against co-accused Manish Paswan. So far as these petitioners
Patna High Court CR. MISC. No.64884 of 2025(2) dt.17-09-2025 2/2 are concerned, they are not named in the F.I.R. Name of these petitioners transpired during course of investigation. Petitioner no. 1 is Mausa and petitioner no. 2 is Mausi of the victim. In the statement, recorded under Section 183 B.N.S.S., though victim has supported the prosecution case, but has not alleged any wrong against these petitioners. Petitioners claim clean antecedent.
5. Learned A.P.P. for the State has opposed the bail petition.
6. Considering the aforesaid facts and circumstances, let the above named petitioners, in the event of their arrest/surrender within a period of eight weeks from today, be enlarged on bail on furnishing bail-bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned District & Additional Sessions Judge VI cum Special Judge (POCSO Act), Sitamarhi in connection with Riga P.S. Case No. 153 of 2025, subject to condition as laid down under Section 482 of the Bhartiya Nagrik Suraksha Sanhita, 2023.
