JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 03-05-2017 Heard learned counsel for the petitioner and learned counsel representing the State.

This criminal miscellaneous application has been filed for modification of the order dated 24.01.2017 on the ground that the petitioner has not surrendered within the time given in the order as petitioner was in Delhi and was suffering from 'Joundice'.

The learned A.P.P. submits that the petitioner has not surrenderrd earlier.

In the facts and circumstances stated above, this application for modification is allowed and petitioner is directed to surrender within a period of three weeks from the date of receipt/production of a copy of this order in the learned lower

Patna High Court Cr.Misc. No.18996 of 2017 (2) dt.03-05-2017 2/2 court and then he shall be released on bail on execution of bail bond of Rs. 10,000/- (ten thousand) with two sureties of like amount each to the satisfaction of the learned C.J.M., Vaishali at Hajipur, in connection with Baligaon P.S. Case No. 14 of 2016, subject to the conditions that one of the bailors must be a near relative and another having sufficient immovable property within the territorial jurisdiction of the court concerned and the petitioner shall remain present on each and every date during trial and the default on two consecutive dates on his part without any reason shall disentitle the petitioner from privilege of bail.
