JUSTICE ASHUTOSH KUMAR ORAL JUDGMENT Date : 29-11-2019 The petitioner has sought a direction to the respondent authorities for making available to him the arrears of salary for the period April, 2016 to September, 2016, from October, 2016 to September, 2017 and from

Patna High Court CWJC No.23719 of 2019 dt.29-11-2019 2/3 June, 2018 to 25th January, 2019. The total period for which the petitioner has not been paid his salary is twenty five months.

2. Repeated representations of the petitioner before the concerned respondents have not yielded any result. Hence, the petitioner considered the necessity of preferring the present petition.

3. Under the aforesaid circumstances, this Court directs the petitioner to make a fresh representation before respondent No. 4, viz., the Superintending Engineer, Building Construction Department, Building Circle, Darbhanga, within a period of four weeks from today, stating in detail and with clarity the claim for the arrears of payment of particular months and particular years.

4. On receipt of such representation, the concerned respondent shall have the facts verified and shall take a decision with respect to the entitlement of the petitioner for staking such claim for the arrears of salary within a period of eight weeks. It is made clear that if the claim of the petitioner is found to be tenable, necessary

5. With the aforesaid observation/direction, the writ petition stands disposed off.
