Earlier the bail application of petitioner was rejected vide order dated 24.03.2022 passed in Cr. Misc. No. 46839 of 2021. Vide order dated 04.01.2023, report was called for regarding the stage of trial and the same has been received, which reveals that one witness has been examined and five witnesses are yet to be examined and on behalf of prosecution and case is fixed for prosecution evidence.

Considering the nature of accusation and progress of trial, I am not inclined to enlarge the petitioner above-named on bail. Accordingly, the same is rejected.

However, trial court is directed to conclude the trial preferably within a period of one year.
