JUSTICE VINOD KUMAR SINHA ORAL ORDER 18-06-2018 Petitioner apprehends his arrest in connection with Bochahan P.S.Case No. 66 of 2017 registered for the offences punishable under Sections 304B and 120B of the Indian Penal Code.
Allegation against the petitioner is of dowry death and petitioner happens to be husband of the deceased. Submission of learned counsel for the petitioner is that as a matter of fact there was dispute with respect to the fact that petitioner has illicit relationship with the sister of the deceased and due to quarrel she has committed suicide and she has taken to hospital and she died during course of treatment. Further submission is that death occurred due to strangulation and witnesses have also supported the fact.

Having heard both sides and in the facts and circumstances, I am not inclined to grant privilege of anticipatory bail to the petitioner.
Petitioner to surrender and make prayer for regular bail, which shall be considered on its own merit, without being prejudiced by this order.
