07-04-2023 Heard learned counsel for the parties.
The petitioners apprehend their arrest in a case registered for the offence under Sections 304(B)/34, 201 of the Indian Penal Code.
It is a case of dowry death.
Petitioner no. 1 is Devar, petitioner no. 2 is mother-in-
Patna High Court CR. MISC. No.66228 of 2022(3) dt.07-04-2023 2/2 law, petitioner no. 3 is grandmother-in-law, petitioners no. 4 to 7 are pattidars of husband and petitioner no. 8 is grandfather-inlaw of the deceased. Thrust of the allegation is against husband of the deceased, who is already in custody. Petitioners are separate in mess & property and have got no concern with the affairs of deceased and her husband. The allegation of torture and demand of dowry is general and omnibus. In fact, the deceased committed suicide by hanging herself. Petitioners have got clean antecedent.
Learned A.P.P. has opposed the prayer for bail. Considering the aforesaid facts and circumstances, let the above named petitioners, in the event of their arrest/surrender within a period of six weeks from today, be enlarged on bail on furnishing bail-bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned J.M. 1st Class, East Champaran at Motihari in connection with Madhuban P.S. Case No. 240 of 2022, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
