2. In the present case, the petitioners seeks bail in connection with Bhagwanpur P.S. Case No. 98 of 2022, registered for the offences under Sections 392, 397, 307 of the Indian Penal Code and Section 27 of the Arms Act.
3. As per the prosecution case, three unknown persons stopped the motorcycle of the informant and snatched Rs. 4,000/- and his mobile phone. One of the persons fired upon the informant and the shot hit the chin. The name of the petitioner transpired during investigation for being involved in the said occurrence.

4. Learned counsel appearing on behalf of the petitioners submit that petitioners are innocent and have been falsely implicated in this case. He further submits that no Test Identification Parade (TIP) has been conducted to ascertain the identity of the miscreants. Nothing incriminating has been recovered from the personal possession of the petitioners. During investigation the police came to know from their informer that the wife of the informant was having affair with the petitioner Sonu Kumar and for this reason the petitioners committed the said occurrence. This is the reason for the false allegation against the petitioners otherwise there is no material to show the complexity of the petitioners in the said occurrence. The petitioners have no criminal antecedent and are in custody since 13.05.2025. The charge-sheet has been submitted.
5. Learned A.P.P. appearing for the State opposes the submission made on behalf of the petitioner.

Having regard to the fact and circumstances and submission made on behalf of the parties and considering the clean antecedent of the petitioners, period of custody, submission of charge-sheet, the petitioners are directed to be released on bail, on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand Only) each with two sureties of the like
Patna High Court CR. MISC. No.67055 of 2025(3) dt.04-11-2025 3/3 amount each to the satisfaction of learned Chief Judicial Magistrate, Begusarai in connection with Bhagwanpur P.S. Case No. 98 of 2022, subject to the condition laid down under Section 480(3) of the BNSS and other following conditions: (i) One of the bailors will be a close relative of the petitioners.
(ii) The petitioners will remain present on each and every date fixed by the court below, if so required by the learned trial court.
(iii) In case of absence on three consecutive dates or in violation of the terms of the bail, the bail bond of the petitioners will be liable to be cancelled by the court concerned.
