2. Heard learned counsel for the petitioner and learned APP for the State.

3. The petitioner seeks bail in Bhagwanganj P.S. Case No. 149 of 2024 registered under Section-30(a) of the Bihar Prohibition and Excise Act.

5. As per prosecution, 30 litres of Mahu liquor is said to have been recovered from a sack, thrown by the petitioner.

6. Learned counsel for the petitioner has submitted that the petitioner is innocent and he has falsely been implicated in this case. The petitioner has been apprehended merely on the

Patna High Court CR. MISC. No.68933 of 2024(2) dt.07-10-2024 2/2 basis of suspicion. No incriminating articles has been recovered from possession of the petitioner. The petitioner has got no criminal antecedent and he is in custody since 22-08-2024.

7. On behalf of the State, it is submitted that the petitioner is named in the F.I.R.

8. Considering the aforesaid facts and circumstances, specially the fact that the petitioner has got no criminal antecedent, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge-II, Patna in connection with Bhagwanganj P.S. Case No. 149 of 2024 subject to the condition that the the petitioner shall cooperate with the trial and make himself available as and when required by the court.
