2. The petitioner seeks regular bail in connection with Sessions Trial No. 427 of 2023 arising out of Kesariya P.S. Case No.16 of 2002 lodged under Sections 302/34 of the I.P.C.

3. As per the prosecution case, F.I.R. has been lodged against three named accused persons including the petitioner with allegation that they have assaulted the informant's husband and due to their assault he has been killed.

4. Counsel further submits that petitioner is innocent and has committed no offence. He further submits that petitioner is in custody since 30.06.2022 having no criminal case pending against him. Charge-sheet has already been filed in this case. Counsel further submits that it is true that petitioner's name is

5. Learned counsel for the State opposes the prayer for bail.

In the present facts and circumstances of this case and the submissions made above, let the petitioner above named, be granted bail and on furnishing bail bonds of Rs.30,000/- (Rupees Thirty thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-V, East Champaran at Motihari in connection with Sessions Trial No. 427 of 2023 arising out of Kesariya P.S. Case No.16 of 2002, subject to the conditions laid down under Section 437 (3) of the Cr.P.C.
