JUSTICE VINOD KUMAR SINHA ORAL ORDER 15-05-2018 The petitioner is apprehending his arrest in connection with Pachrookhi P.S. Case No. 192 of 2016, registered for offences punishable under Sections 392 of the Indian Penal Code. Allegation as per F.I.R. that three persons chased the informant and snatched the motorcycle from the informant. It has been submitted on behalf of the petitioner that he is not named in the F.I.R later on his name transpired during course of investigation on the basis of confession of co-accused and except that there is nothing against the petitioner. Heard learned A.P.P. also.

Having heard both sides, considering the facts and circumstances of the case and also the fact that petitioner is accused in two more cases, I am not inclined to grant the privilege

Patna High Court Cr.Misc. No.17406 of 2018 (3) dt.15-05-2018 2/2 of anticipatory bail to the petitioner, this application is accordingly dismissed.

However, the petitioner is directed to surrender before the court below within a period of four weeks and make prayer for regular bail, which will be considered by the court below on the basis of materials available on record and the court below shall pass an appropriate order, if possible on same day, without being prejudiced by the order of this Court.
