2. The petitioners apprehend their arrest in connection with Fatehpur P.S. Case No. 662 of 2022 registered for the offences punishable under Sections 341, 323, 308, 504/34 of the Indian Penal Code.

3. As per allegation, the accused persons including the petitioners entered the field of the informant and started abusing and assaulting them by means of lathi and iron rod, as a result of which, he sustained head injury.

4. The learned counsel for the petitioners has submitted that the petitioners are innocent and have falsely been implicated

Patna High Court CR. MISC. No.69109 of 2024(2) dt.23-10-2024 2/2 in this case. He has further submitted that admittedly, there is land dispute between the parties. The allegation against petitioner no. 1 and petitioner no. 3 are general and omnibus whereas there is specific allegation against petitioner no. 2 that he assaulted Pappu Paswan on his head. The injury report of Pappu Paswan has been annexed which shows that the injuries are simple in nature.

5. Considering the above-mentioned facts and circumstances, let the petitioners, in the event of their arrest or surrender within four weeks before the learned court below, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-Xth , Gaya in connection with Fatehpur P.S. Case No. 662 of 2022, subject to the conditions as laid down under Section 438(2) Cr.P.C. (Nawneet Kumar Pandey, J) Nirmal/- U T
