JUSTICE VINOD KUMAR SINHA ORAL ORDER 30-08-2018 The petitioner is apprehending his arrest in connection with Complaint Case No. 1190 (C) of 2013, registered for offences punishable under Sections 406, 420 and 120-B of the Indian Penal Code.
Allegation as per F.I.R. against the petitioner is that who is the Incharge Principal of the said college, of illegal withdrawal of money from the account of the college.
Submission of learned counsel for the petitioner is that on the basis of complaint case the F.I.R. was registered and police after investigation found the case false and as such recommended institution of case under Section 182 and 211 I.P.C., however, cognizance has been taken on the protest petition. It has further been submitted that earlier a case was lodged against the
Patna High Court Cr.Misc. No.30642 of 2018 (4) dt.30-08-2018 2/2 informant with respect to defalcation of money and for that the present case has been filed.
Heard learned A.P.P. also.
Nobody appears on behalf of opposite party no.2 inspite of service of notice.
Having heard both sides, considering the facts and circumstances of the case, let the petitioner above named, in the event of his arrest or surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bond of Rs. 25,000 (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned J.M., First Class, Madhepura, in connection with Complaint Case No. 1190 (C) of 2013, subject to the conditions as laid down under Section 438(2) of the Cr.P.C, it is further subject to the condition that:- (i) One of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the concerned Court.
