The petitioner apprehends arrest in Daraunda P.S. Case No. 190 of 2017 instituted for the offence under Sections 341,323,324,379,325,504,506/34 of the IPC.

There is allegation in the written report that this petitioner along with others assaulted informant and also gave farsa blow on the head of Santosh Kumar Tiwary on account of which he sustained cut injury on the head and fell down. Case diary has been received, wherein, injury report of the informant and Santosh Kumar Tiwary is available. Doctor has found injuries on informant to be simple in nature and one lacerated wound at right temporal parietal joint measuring about 2''x1/2''x bone deep on Santosh Kumar Tiwary. Report says crack fracture

Patna High Court Cr.Misc. No.14656 of 2018(3) dt.23-04-2018 2/2 in the right temporal parietal bone. Doctor has opined injuries to be grievous in nature caused by hard and blunt substance. Keeping in view, the direct allegation against the petitioner, this Court is not inclined to grant anticipatory bail to the petitioner.

Accordingly, this anticipatory bail petition stands rejected.

The petitioner is directed to surrender in the court below within six weeks from today and seek regular bail which will be considered by the court below in accordance with law and disposed off preferably on the same day, without being prejudiced by this order.
