The petitioners seek anticipatory bail in connection with Barbigha P. S. Case No. 22 of 2018, registered for offences punishable under Sections 448, 147, 323, 324, 307, 379, 504 and 506 of the Indian Penal Code.
Allegation against the petitioners is that the petitioners along with other co-accused variously armed with rod, lathi and hasuli came on motorcycle and tempo and entered in the house of the informant and assaulted the informant and her son and snatched away golden chain.
Submission of the learned counsel for the petitioners is
Patna High Court Cr.Misc. No.27517 of 2018 (3) dt.10-05-2018 2/3 that the petitioners have been falsely implicated in this case and all injuries are simple in nature and no specific allegation have been attributed against them and earlier to that, daughter of the petitioner has already lodged a case against the informant and others.
Learned A.P.P. opposes the prayer for bail.
Having heard both sides and in view of the facts and circumstances as discussed above, let the petitioners, in the event of arrest or surrender before the court below within a period of six weeks from the date of order, be released on bail on furnishing bail bond of Rs. 25,000/- (Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Sheikhpura in connection with Barbigha P.S.Case No. 22 of 2018, subject to the condition that as laid down under Section 438 (2) of the Code of Criminal procedure. With following conditions:- i) One of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the concerned court.
ii) The petitioner will not induce any witness or tamper with the evidence.
Patna High Court Cr.Misc. No.27517 of 2018 (3) dt.10-05-2018 3/3 iii) The petitioner shall co-operate in the investigation of the case and make himself available as and when required by the Police, otherwise, the prosecution is free to move for cancellation of his bail bond.
