2. The petitioner has preferred this application for grant of regular bail in connection with Jankinagar P.S. Case No. 135 of 2025 dated 15.05.2025 registered for the offences punishable under Section 309(6), 312, 109 of B.N.S. and Section 27 of the Arms Act.

3. As per the prosecution case, two unknown miscreants ridden on motorcycle are alleged to have surrounded the informant and demanded money by showing weapon. When the informant said that he didn't have money and they might take his bike and mobile, then one of the accused persons fired on him and when the informant raised alarm and tried to flee

Patna High Court CR. MISC. No.64746 of 2025(2) dt.13-10-2025 2/3 away then both the accused persons fired on the informant. Two bullets hit the waist of the informant. On hearing the noise of gunshot and scream of the informant, nearby people gathered thereafter the accused persons fled away.

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. The petitioner is not named in the FIR. The name of the petitioner has sprung up in this case during the course of investigation. The charge-sheet has been submitted against the petitioner. Nothing has been recovered from the conscious possession of the petitioner. As per the impugned order dated 29.07.2025, the gunshot injury is mentioned but the nature of injury has not been mentioned. The petitioner has no concern with the alleged occurrence. The petitioner has one criminal antecedent as stated in para 3 of the bail petition. The petitioner is in custody since 24.05.2025.

5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner.

6. Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of

Case No. 135 of 2025, with a condition:- (i) The petitioner is directed to remain physically present before the learned Court below on each and every date, failing which on two consecutive dates without reasonable cause, the bail bonds of the petitioner are liable to be cancelled.
