2. The petitioners apprehend their arrest in connection with Amarpur P.S. Case No. 891 of 2023, registered for the offences punishable under Section 392 of the Indian Penal Code.

3. As per allegation, the petitioners, with the connivance of two other accused persons, committed theft of tractor and thresher of the informant.

4. The learned counsel for the petitioners has submitted that the petitioners are innocent and have falsely been implicated in this case. They are the persons of clean

Patna High Court CR. MISC. No.69084 of 2024(2) dt.23-10-2024 2/2 antecedent. He has submitted further that the informant is not an eye-witness and one of the witnesses, named in the FIR, has filed an affidavit stating therein that the petitioner is not involved in the alleged occurrence.

5. Considering the above-mentioned facts and circumstances, let the petitioners, in the event of their arrest or surrender within four weeks before the learned court below, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Banka in connection with Amarpur P.S. Case No. 891 of 2023, subject to the conditions as laid down under Section 438(2) Cr.P.C. (Nawneet Kumar Pandey, J) kundan/- U T
