JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 19-07-2022 This application has been preferred for quashing of the First Information Report being Maniyari P.S. Case No.24 of 2017 dated 09.02.2017 registered for the offences punishable under Sections 272 and 273 of the Indian Penal Code and Sections 35© and 35(D) of the Bihar Prohibition and Excise Act, 2016.
Although learned counsel for the petitioner submits that till date the investigation is not complete, Mr. Vivek Prasad, learned GP-7 has drawn the attention of this Court towards the
Patna High Court CR. WJC No.599 of 2017(7) dt.19-07-2022 2/2 statement made in paragraph '7' of the counter affidavit filed in this case on behalf of the respondent no.3. In paragraph '7' it is stated inter-alia that investigation in this case is complete on all the points and the investigating officer has closed the case on 31.05.2022.
In the aforesaid view of the matter, nothing survives for adjudication in the present writ application. It is disposed off with liberty to the petitioner that in case the petitioner will have any fresh cause of action, he may seek his remedy against that in accordance with law.
