JUSTICE SANDEEP KUMAR ORAL ORDER 08-12-2023 This is the second attempt of the petitioner for grant of regular bail as earlier the bail application of the petitioner has been rejected vide order dated 19.05.2023 passed in Cr. Misc. No. 24299 of 2023.

2. Heard the learned counsel for the petitioner and learned APP for the State.

3. The petitioner seeks bail in connection with Balia P.S. Case No. 383 of 2021 registered for the offence under Sections 392/34 of the Indian Penal Code.

4. The prosecution story in short is that the petitioner is accused of snatching the bag of the informant in which there was a Dell Laptop and a mobile phone.

5. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case.

6. Learned counsel for the petitioner also submits that the petitioner is in custody since 29.09.2022.

7. Learned A.P.P. has vehemently opposed the prayer for bail.

8. Considering the aforesaid facts and the period of custody, this application for regular bail is allowed.

9. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned CJM, Begusarai in connection with Balia P.S. Case No. 383 of 2021.

10. As a condition of this order, the petitioner will mark his attendance at Dandari Police Station on the first and third Sunday of each month. Any default in appearance at the Police Station would result in cancellation of bail bond of the petitioner.
