2. Petitioner seeks bail, who is in custody since 26.03.2023, in connection with POCSO G.R. No. 63 of 2023 arising out of Hajipur Sadar P.S. Case No. 551 of 2022, F.I.R. dated 19.07.2022 registered for the offences punishable under Sections 341, 342, 323, 376 of the Indian Penal Code and Sections 4/6 of the POCSO Act and Sections 3(i)(r)(s) of SC/ST Act.
3. Earlier the bail petition of the petitioner was rejected vide order dated 18.08.2023 passed in Cr. Misc. No.
Patna High Court CR. MISC. No.70139 of 2024(3) dt.03-12-2024 2/2 41089 of 2023.
4. Vide order dated 04.10.2024 a report was called for with regard to the stage of the trial. Report dated 16.11.2024 of the learned Trial Court reveals that all the prosecution witnesses have already been examined in the present case and the case is pending for argument.
5. Considering the aforesaid facts and circumstances of the case as well as nature of allegation in the F.I.R and in view of the report of the learned Trial Court, I am not inclined to enlarge the petitioner on bail in connection with POCSO G.R. No. 63 of 2023 arising out of Hajipur Sadar P.S Case No. 551 of 2022 pending in the Court of learned Additional District Sessions Judge- 6th-cum-Special Judge, POCSO, Hajipur, Vaishali.
6. Prayer is refused.
7. However, the learned Trial Court is directed to expedite the trial and conclude the same at the earliest. (Rajesh Kumar Verma, J) Ibrar//- U T
