JUSTICE VINOD KUMAR SINHA ORAL ORDER 11-05-2017 This is an application for grant of anticipatory bail for offences punishable under Sections 452, 379/34 of the Indian Penal Code and Section 27 of the Arms Act.
Petitioner was the informant in this case but later on, it appears that she has been made accused in this case. Heard learned counsel for the petitioner.
It has been submitted on behalf of the petitioner that she has falsely been implicated in this case only on the fact that she is accused in connection with Town P. S. Case no. 523 of 2014 but no case is made out against her. Further it is submitted that she is a lady.
Heard learned A.P.P. also. He has opposed the
Patna High Court Cr.Misc. No.19528 of 2017 (2) dt.11-05-2017 2/2 prayer for anticipatory bail.
Having heard both sides and in view of the facts and circumstances, I am not inclined to grant anticipatory bail to the petitioner.
However, petitioner may surrender in the court below at Begusarai, in connection with Begusarai Moffussil P. S. Case no. 417 of 2016 and make prayer for regular bail which will be considered on the fact that she is a lady and also considering the materials available on record he will pass an appropriate order without being prejudiced by the order of this Court. Accordingly, this application is dismissed.
