JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 29-05-2017 Heard learned counsel for the petitioner and the State. The petitioner apprehends his arrest in Pakridayal P.S. Case No. 50 of 2016 for the offences punishable under sections 188, 358, 147, 148, 149, 341, 342, 323, 504 and 506 of the Indian Penal Code and Section 27 of the Arms Act. The petitioner is not named in the FIR.

The case was registered at the instance of Returing Officer of both No. 131 of Thervitiya Gram Panchayat in 2016 election.

Similarly situated other co-accused have been granted anticipatory bail in Cr. Misc. No. 5362 of 2017 and Cr. Misc. No. 18414 of 2017 by a Bench of this Court vide orders dated 21.3.2017 and 4.5.2017 respectively.

No.19740 of 2017 (2) dt.29-05-2017 2/2 Since petitioner is not named in the FIR and similarly situated co-accused have been granted anticipatory bail, I am inclined to enlarge the petitioner named above, on bail, in the event of his arrest or surrender before the learned court below within a period of four weeks from the receipt/production of the order, on furnishing bail bond of Rs. 25,000/- (Twenty five thousand) with two sureties of the like amount each to the satisfaction of A.C.J.M.,-V, East Champaran at Motihari, in connection with Pakridayal P.S. Case No. 50 of 2016, subject to the condition as laid down under section 438(2) of the Cr.P.C. (Anil Kumar Upadhyay, J) Ravi/- U T
