JUSTICE SANJAY PRIYA ORAL ORDER 26-04-2018 Heard learned counsel for the petitioner and the State. The petitioner apprehends his arrest in Hajipur Town P.S. Case No. 677 of 2017 instituted for the offence under Sections 324, 307, 506/34 of the Indian Penal Code and Section 27 of the Arms Act.

Learned counsel for the petitioner has submitted that there are several criminal cases pending against the informant. The informant and his family members had given threat of dire consequences for which the informant has filed an Informatory petition before the learned Chief Judicial Magistrate, Vaishali at Hajipur, vide Informatory Petition No. 3153 of 2017. It has further been submitted that prior to this case, on 28.8.2016, Hajipur Town P.S. Case No. 612 of 2016 was registered against the informant on account of murder of father of the

Patna High Court Cr.Misc. No.15671 of 2018 (3) dt.26-04-2018 2/2 petitioner.

In the instant case there is allegation that this petitioner made firing, causing injury in the hands of the informant. Learned counsel for the informant has appeared and submitted that Doctor has found wound of entry and wound of exit on the right shoulder of the informant.

In the written report there is specific allegation against the petitioner of making firing upon the informant which hit on his shoulder. The informant was admitted in Sadar Hospital from where he was referred to PMCH.

Learned counsel for the informant has appeared and opposed the prayer for anticipatory bail.

Learned A.P.P. has submitted that all the witnesses in the case diary have levelled specific allegation against the petitioner. Therefore, this Court is not inclined to grant anticipatory bail to the petitioner.

Prayer for anticipatory bail to the petitioner stands rejected.

Petitioner may surrender before the court below and make prayer for regular bail.
