====================================================== CORAM: HONOURABLE MR. JUSTICE BIRENDRA KUMAR ORAL ORDER 15-10-2019 Heard learned counsel for the petitioner and learned APP for the State.

Petitioner seeks bail in a case registered for the offences punishable under Sections 353, 307, 120B, 427, 302/34 of the Indian Penal Code, Section 27 of the Arms Act, Sections 3⁄4 of the Explosive Substance Act and Section 17 of the C.L.A. Act.

Submission is that the FIR of the occurrence of murder is against unknown. Petitioner is in custody since 17.06.2014. Only material against the petitioner is his criminal antecedent. He was never put on T.I. Parade during investigation of the case.

Considering the nature of allegation and period already undergone as well as grant of bail to co-accused Anurag

Patna High Court CR. MISC. No.60634 of 2019(2) dt.15-10-2019 2/2 Vishwakarma by a Coordinate Bench of this Court vide order dated 05.07.2013 passed in Cr. Misc. No. 22816 of 2013, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Sessions Trial No. 94 of 2014 arising out of Shyampur Bhataha Police Station Case No. 59 of 2010, subject to the following conditions:- (a) The petitioner shall fully cooperate with the trial of the case, failing which the learned court below shall be at liberty to cancel the bail bond of the petitioner. (b) Both the bailors shall be resident of the territorial jurisdiction of the learned court below.
