2. In the present case, the petitioner seeks bail in connection with Sikraul P.S. Case No. 01 of 2024, registered for the alleged offence under Sections 419, 420, 467, 471, 414/34 of the Indian Penal Code.
3. As per prosecution case, the co-accused persons were found riding a stolen four wheeler vehicle. They disclosed the name of another co-accused Arvind Yadav who could tell about the antecedent of the vehicle. The co-accused Arvind Yadav further disclosed the name of this petitioner from whom he purchased the stolen vehicle and was using the same for smuggling of illicit liquor.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this case. The co-accused, who were apprehended from the vehicle and also the co-accused who disclosed the name of the petitioner have been granted bail vide orders dated 04.04.2024, 04.10.2024 and 28.06.2024 passed in Cr. Misc. Nos. 22832 of 2024, 56625 of 2024 and 25747 of 2024, respectively by a Coordinate Bench of this Court. The case of the petitioner is on much better footing. Nothing incriminating has been recovered from the person/possession of this petitioner and no material has come up during investigation to show complicity of the petitioner in the whole occurrence. The petitioner is having antecedent of five cases and in four cases he is on bail and in one case closure report has been submitted. The petitioner is in custody since 04.08.2025.
5. Learned A.P.P. opposes the submission made on behalf of the petitioner.
6. Having regard to the facts and circumstances and submissions made hereinabove and considering the fact that no recovery has been shown from the petitioner and further considering the lack of substantive material against the petitioner and also considering the grant of bail to the other co-

No.64822 of 2025(2) dt.17-09-2025 3/3 accused persons, the petitioner is directed to be released on bail on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate 1st Class, Buxar/court concerned, in connection with Sikraul P.S. Case No. 01 of 2024, subject to the conditions mentioned in Section 480 (3) of BNSS and also the following conditions :
(i) One of the bailors will be a close relative of the petitioner.
(ii) The petitioner will remain present on each and every date fixed by the court below.
(iii) In case of absence on three consecutive dates or in violation of the terms of the bail, the bail bond of the petitioner will be liable to be cancelled by the court concerned.
