====================================================== CORAM: HONOURABLE MR. JUSTICE CHANDRA PRAKASH SINGH ORAL ORDER 13-10-2025 Heard learned counsel for the petitioner, learned counsel for the informant and learned A.P.P. for the State.

2. The petitioner seeks bail in connection with Rajapakar (Barauti O.P.) P.S. Case No. 144 of 2025 dated 02.05.2025 registered for the offences punishable under Section 103(1) read with Section 3(5) of the B.N.S., 2023.

3. As per the prosecution case, the petitioner and the other co-accused persons are alleged to have committed murder of the husband of the informant.

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. It is submitted that there is no specific allegation against the petitioner. There is general and omnibus allegation

Patna High Court CR. MISC. No.65556 of 2025(2) dt.13-10-2025 2/2 against the petitioner. The petitioner has no concern either with the alleged offence or with the other co-accused persons. It is further submitted that the charge sheet has been submitted under Section 103(1) of the B.N.S., 2023 against the petitioner. Hence, there is no chance of tampering with the evidence. The petitioner has clean antecedent as stated in paragraph no. 3 of the bail petition. He is in custody in this case since 03.05.2025.

5. Learned A.P.P. for the State and learned counsel for the informant have vehemently opposed the bail petition of the petitioner.

6. Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner, above named, is directed to be enlarged on bail on furnishing bail bond of Rs. 20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-XV, Vaishali at Hajipur in connection with Rajapakar (Barauti O.P.) P.S. Case No. 144 of 2025.

7. The application stands allowed.
